Purpose
The purpose of these General Conditions is to define the terms of provision of the services of the fimco.fr site, hereinafter referred to as “the Service”, and the Conditions of Use of the Service by the User.
Any access and/or Use of the www.fimco.fr site shall be taken to constitute acceptance of and compliance with all the terms of these Conditions and unconditional acceptance of them. They therefore constitute an agreement between the Service and the User.

Definitions
User: The User is any person who uses the site or any of the services offered on the site.
Access to the service
The Service may be accessed free of charge by any user with internet access. The user has sole liability for all costs relating to access to the Service, whether these are hardware, software or internet access costs. They have sole responsibility for the proper functioning of their computer equipment and internet access.
Fimco reserves the right to refuse access to the Service, unilaterally and without prior notice, to any User who does not comply with these conditions of use.
FIMCO shall implement all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to achieve this
FIMCO may not, moreover, be held responsible for any network or server malfunction or any other event that may not be reasonably considered to be under their control, which may prevent or reduce access to the Service.
FIMCO reserves the right to interrupt, temporarily suspend or modify all or part of the Service without prior notice, to carry out maintenance work or for any other reason, with the interruption providing no grounds for any obligation or compensation.
Intellectual property
The fimco.fr site, and its content in particular, are protected by the laws in force in France.
FIMCO and Alexis Barbet are the exclusive holders of all intellectual property rights to the site and its content (text, photographs, illustrations, images, etc.).
The content reproduced on the site is copyrighted and any reproduction or distribution of it without express permission in writing from FIMCO shall constitute a punishable infringement. All the brands mentioned (Carrefour, Cora, Match, Super-U, Leclerc, ED, Auchan, Carrefour Market, Simply Market, Leader Price, Dia...) are trademarks of the relevant distribution groups.
FIMCO, Laboca and Nouvelle Vague are trademarks of FIMCO. Any unauthorised reproduction of these brands, logos and distinguishing marks signs constitutes a punishable infringement. The offender puts themselves at risk of civil and penal penalties, in particularly the penalties set out in articles L. 335.2 and L. 343.1 of the Intellectual Property code.
The User has sole responsibility for the User Content that they put online using the Service, as well as the texts and/or opinions that they formulate. The User grants FIMCO all related intellectual property rights expressly and free of charge, in particular the right of reproduction, representation and adaptation, for the term of legal copyright protection. In particular, they pledge that this data shall not be harmful to the legitimate interests of any third parties, whoever they may be.
In that capacity, they guarantee FIMCO against any claims based directly or indirectly on these statements and/or this data that may be brought by anyone against FIMCO. In particular they pledge to pay any sums that may be incurred as a result of any third party claims against FIMCO, including lawyers’ fees and legal costs.
FIMCO reserves the right to remove all or part of the User Content, at any time and for any reason, without warning or prior justification. The User may not bring any claims as a result of this.
Personal data
Out of concern for Users’ privacy, FIMCO undertakes to ensure that personal information gathered on this site shall be gathered in accordance with law no. 78-17 of 6 January 1978 on computing, files and liberties, known as the “Computing and Liberties” Law.
In accordance with article 34 of the “Computing and Liberties” law, FIMCO guarantees the User a right to contest, access and correct personal data about themselves.

Limits of responsibility
The fimco.fr site is an information site about new technologies, and subjects relating to computing in particular.
The information given on the site fimco.fr site comes from sources deemed to be reliable. However, FIMCO cannot guarantee that this data is accurate or relevant. Furthermore, the information provided on this site is shown for information purposes only and may under no circumstances constitute advice or a recommendation of any kind.
Consequently, under no circumstances may FIMCO be held responsible for any use of the information and content available on the whole site, in any capacity whatsoever. The User is solely responsible for using the information made available on the Site with discernment and presence of mind.
Moreover, the User undertakes to compensate FIMCO for any harmful consequences linked directly or indirectly to their use of the Service.
Access to certains sections of the fimco.fr site requires the use of a Username and Password. The Password, chosen by the user, is personal and confidential. The user undertakes to keep their password secret and refrain from disclosing it in any form. The User uses their Username and Password on the internet at their own risk. It is up to the User to take all necessary steps to protect their own data against any security breach.
FIMCO nonetheless undertakes to put in place all means necessary to guarantee the security and confidentiality of transmitted data. The User is informed that one or more cookies, containing no personal information, may be placed on their hard disk to identify them.
The User acknowledges that they are aware of the specific limitations and constraints of the internet network and, as such, recognises in particular that it is impossible to fully guarantee the security of any data exchanged. FIMCO may not be held responsible for any prejudice resulting from the transmission of any information, including username and/or password information, via the Service.
Under no circumstances may FIMCO be held responsible, within the limit of applicable law, for any prejudice or damage, direct or indirect, material or moral, or of any nature whatsoever, that may result from inavailability of the Service or any Use of the Service. The term “Use” should be understood in the broad sense, that is, any use of the site whatsoever, lawful or otherwise.
In a general manner, the User undertakes to comply with all regulations in force in France.
Hypertext links
fimco.fr displays hypertext links to websites published and/or managed by third parties.
Insofar as they have no control over these external resources, the User acknowledges that FIMCO shall accept no responsibility for making these resources available, and may not be held responsible for their content. FIMCO may not be held responsible in the event of acts of God or facts beyond their control. Changes to this agreementt: FIMCO reserves the right to modify the terms, conditions and information in this agreement at any time.
The User is therefore advised to regularly consult the latest version of the Conditions of Use on the www.fimco.fr site.
Term and cancellation
The parties enter into this agreement for an indeterminate term starting from the first time that the User uses the Service.
Applicable law and competent jurisdiction
The legal rules applying to content and transmission of data on and around the site are determined by French law. In the event of litigation, if an amicable agreement cannot be reached, only the French courts under the jurisdiction of the Paris court of appeal shall be competent.
